Co-Workers' Retained Vender Lists Create Issue of Fact in Mesothelioma Case, Court Rules

MADISON, Wis. - A Wisconsin appeals court has reversed an award of summary judgment to a company that, according to testimony presented by the plaintiff's co-workers, may have supplied an asbestos-containing product that allegedly contributed to the plaintiff's death. Zielinski v. A.P. Green Industries, Inc., et al., No. 02-1888 (Wis. App. Ct., First Dist.).

In an opinion issued Feb. 18, the First District Wisconsin Court of Appeals found that information contained in vender lists retained by the co-worker after he left his job at the Ladish Company created an issue of fact precluding summary judgment to the supplier.
