Judge Dismisses Asbestos Complaints for Failure to Plead Location of Exposure

WILMINGTON, Del. - A state court judge has thrown out more than 80 lawsuits filed on behalf of iron workers who claimed they developed asbestosis as a result of their asbestos exposure. Archie, et al., v. 4520 Corp., Inc., et al., No. 02C-08-204-ASB (Del. Super., New Castle Cty.).

Saying the allegations are too vague to support a claim under state law, the Delaware Superior Court judge dismissed the lawsuits on March 3, without prejudice. The plaintiffs were given 30 days to amend their complaints.
