Imerys Talc, Cyprus Amax Move to Dismiss 2 Asbestos Cosmetic Talc Cases on Jurisdictional Grounds

NEW YORK –– Defendants named in two asbestos-containing cosmetic talc cases have filed motions to dismiss, maintaining that the court does not have jurisdiction over the claims.

In the recent motions filed Dec. 26 in the New York Supreme Court for New York County, defendants Imerys Talc America Inc. and Cyprus Amax Minerals Co. moved to dismiss two complaints for lack of personal jurisdiction, maintaining that the plaintiffs have not physically been to New York, have never purchased any of the allegedly harmful products in the state, or fail to allege exposure to talcum powder or any asbestos-containing products in …
