Kansas Court Denies Defense Efforts to Add Expert Witness After Disclosure Deadline in Asbestos Case

KANSAS CITY, Mo. –– A Kansas federal court has denied a defense request to add an expert witness and to reopen discovery, finding that no good cause existed for the late disclosure.

In the Jan. 3 order, the U.S. District Court for the District of Kansas opined that the defendant had failed to show that it could not, or should not, have discovered the expert in a timely manner.

The plaintiffs brought the claims on behalf of Robert L. Rabe, contending that the decedent developed injuries as a result of exposure to asbestos-containing products. The scheduling order in effect …
