Pneumo Abex Denied Summary Judgment in Automechanic’s Asbestos Case

WILMINGTON, Del. –– A Delaware court has denied Pneumo Abex’s motion for summary judgment in an asbestos case filed by a former automotive mechanic, saying the evidence proffered by the plaintiff created a factual question more appropriately determined at trial.

In the Nov. 8 order, the Delaware Superior Court opined that this evidence was enough to satisfy Rhode Island’s frequency, regularity, and proximity test.

Plaintiff Raymond Leathers asserted the claims, contending that he was exposed to asbestos from Pneumo Abex’s products while working as an automotive mechanic in the 1960s. During the course of his employment, Leathers testified that he …
