Pa. Court Tosses Plaintiff Expert Testimony in Asbestos-Containing Talc Case, Says Experts Deviated from ‘Generally Accepted Methodologies’

PHILADELPHIA –– A Pennsylvania court has found expert testimony proffered by the plaintiffs in an asbestos-containing talc case to be inadmissible, saying that one expert used a “mishmash of scientifically accepted methodologies.”

In the Sept. 25 opinion, the Pennsylvania Court for Commons Pleas for Philadelphia County found that the plaintiffs’ experts modified, varied and, eventually, deviated from generally accepted methodology.

In reaching this conclusion, the court granted defense motions to preclude the experts’ testimony.
