California Judge Remands Postal Worker's Asbestos Claim

SAN FRANCISCO - An automaker's attempt to remove an asbestos products liability action to federal court has failed because it wasn't done within 30 days of the first defendant's receipt of the complaint, a federal judge has ruled. Morgan v. Asbestos Defendants, No. 02-05761 (N.D. Calif.).
Judge William Alsup of the U.S. District Court for the Northern District of California said Feb. 27 that DaimlerChrysler was six days late in filing its petition to remove the asbestos personal injury complaint, which was initially filed in San Francisco Superior Court by Donald and Rena Morgan.
