WILMINGTON, Del. –– A Delaware magistrate judge has recommended the denial of a motion for partial summary judgment on punitive damage claims in an asbestos case, opining that the plaintiff had submitted enough evidence to create a genuine issue of material fact.

In an Aug. 30 report and recommendation, U.S. Magistrate Judge Sherry R. Fallon of the U.S. District Court for the District of Delaware said that the trier of fact should assess whether John Crane had knowledge of asbestos-related dangers.
