NEW ORLEANS –– A Louisiana federal court has remanded an asbestos action after determining that Avondale Industries had failed to establish that existence of a necessary causal nexus between the defendant’s actions under color of a federal office and the plaintiffs’ claims.
In the Aug. 4 opinion, the U.S. District Court for the Eastern District of Louisiana opined that, as such, removal was improper and the case must be remanded for lack of subject matter jurisdiction.
