Del. Court Awards Summary Judgment to Sears Roebuck Co. in Asbestos Case

WILMINGTON, Del. –– A Delaware court has awarded summary judgment to Sears Roebuck Co. in an asbestos case, finding that, under the law governing the claims, the defendant could not be held liable for a product it did not manufacture.

In the July 12 opinion, the Delaware Superior Court wrote that the plaintiff had failed to show that the product was sold in a defective condition and that the implied warranty was breached.
