WILMINGTON, Del. –– A Delaware court has denied Cleaver-Brooks’ motion for summary judgment, rejecting the defendant’s position that the plaintiff had failed to establish that there was an alleged defect in its product.
In the July 12 opinion, the Delaware Superior Court opined that a reasonable jury could find that Cleaver-Brooks’ products were a substantial factor in causing the plaintiff’s injury.
