Del. Court Denies Cleaver-Brooks Motion for Summary Judgment in Asbestos Case

WILMINGTON, Del. –– A Delaware court has denied Cleaver-Brooks’ motion for summary judgment, rejecting the defendant’s position that the plaintiff had failed to establish that there was an alleged defect in its product.

In the July 12 opinion, the Delaware Superior Court opined that a reasonable jury could find that Cleaver-Brooks’ products were a substantial factor in causing the plaintiff’s injury.

Plaintiff Clarence Dionne filed the complaint, saying that he was exposed to Cleaver-Brooks’ boilers while he was working at Bay Area Medical Center. Dionne specifically pointed to the rope gaskets on the doors of the boilers as the source …
