ALBANY, N.Y. –– A New York appellate court has reversed awards of summary judgment entered in favor of three asbestos defendants, finding the companies had failed to offer sufficient proof to rebut the plaintiffs’ claims.
In the July 6 opinion, the New York Supreme Court, Appellate Division, Third Judicial Department, wrote in part that the defendants’ lack of documentation from the time period in question does not establish that they did not sell asbestos-containing products.
