Calif. Appellate Court Reverses Award of Summary Judgment to Shell, Says Defendant Liable for Take-Home Exposure Claims

LOS ANGELES –– A California appellate court has reversed its prior holding that Shell is entitled to summary judgment on take-home asbestos exposure claims, saying a recent ruling from the state’s highest court demands a different outcome.

In a June 5 opinion, the California Second Appellate District, Division 3, applied the guidelines outlined by the California Supreme Court in its recent Kesner decision and concluded that since the plaintiff was the wife of a former Shell employee, she was a foreseeable plaintiff.
