NEW YORK - A state court judge in New York has ordered a hearing to determine whether there is sufficient agreement within the scientific community regarding a between asbestos-related disease and exposure to welding rods. Tucker, et al. v. ACandS, Nos. 0105031/02, 10146/01 (N.Y. Sup. Ct., New York Cty.).
Judge Helen E. Freedman of the New York County Supreme Court ordered the hearing after considering motions for summary judgment in an asbestos case filed by two men who claimed they developed asbestos-related diseases after working with the rods.
