Del. Court Awards Summary Judgment to Ford Motor Co. in Asbestos Case

WILMINGTON, Del. –– A Delaware court has awarded summary judgment to Ford Motor Co., concluding that the plaintiff had failed to show that he was exposed to friable asbestos from the defendant’s product.

In the May 10 opinion, the Delaware Superior Court explained that the only product identification witness in this case is the plaintiff and a jury would have to speculate that the auto parts were in fact manufactured by Ford Motor.

Plaintiff Paul Norris contended that his occupational and non-occupational exposure to asbestos fibers in brakes, clutches, and gaskets caused him to develop lung cancer.
