WILMINGTON, Del. –– A Delaware court has awarded summary judgment to a roof cement manufacturer in an asbestos case, concluding that the plaintiffs had failed to demonstrate that the defendant’s product was a cause of his lung cancer.
In the April 4 ruling, the Delaware Superior Court opined that the plaintiffs had failed to demonstrate beyond speculation that it was a significant probability that Bird Inc.’s roofing cement caused the plaintiff’s injury.
