WILMINGTON, Del. –– A Delaware court has awarded summary judgment to an asbestos defendant, finding that the plaintiff had failed to establish that a special relationship existed between the decedent and the product manufacturer in the take-home exposure case.
In the Feb. 2 opinion, the Delaware Superior Court found that the defendant had met its burden of proving that no duty of care existed between the parties.
