N.Y. Court Weighs in on In Limine Motions in Asbestos Case; Refuses to Preclude Alleged ‘Any Exposure’ Testimony

NEW YORK –– A New York trial court has denied, in part, a number of defense in limine motions filed in asbestos case, opining that precluding the plaintiffs’ expert testimony in the way requested by the defendants would “forestall recovery in nearly all asbestos cases.”

In the Jan. 4 order, the New York Supreme Court for New York City weighed in on a number of other defense motions, including those relating to the state-of-the-art witnesses and the admissibility of regulatory materials.
