CLEVELAND - An appeals court in Ohio has affirmed a verdict awarded to two former rail workers, determining that evidence presented on their behalf was admissible despite being based on professional, rather than hands on experience. Shesler, et al. v. Consolidated Rail Corp., et al., No. 80950 (Ohio App. Ct., Eighth Dist.).
In doing so, the Eighth District Ohio Court of Appeals upheld testimony by one expert who produced a work practice study to show that the rail workers' practice of resting their feet on cab heater pipes present on their locomotives caused harmful amounts of asbestos to be released …
