Wash. Court Affirms Dismissal of Asbestos-Related Wrongful Death Suit, Says Claims are Time-Barred

OLYMPIA, Wash. –– The Washington Supreme Court has affirmed the dismissal of asbestos-related wrongful death claims, finding that the suit was untimely since the statute of limitations on the underlying personal injury claims on which the wrongful death claims are based lapsed during the decedent’s life.

In the Oct. 6 opinion, the high court opined 5-4 that the plaintiff in the instant case has not been harmed by the state’s position on the timeliness of wrongful death claims since the decedent was able to recover on personal injury claims prior to his death.
