3rd Circuit Reverses in Part Award of Summary Judgment for CBS Corp. in Asbestos Case

PHILADELPHIA –– The 3rd Circuit U.S. Court of Appeals has reversed in part an award for summary judgment for asbestos defendant CBS Corp., finding that the plaintiff had presented sufficient evidence that the defendant’s switchgears “were likely to contain asbestos that resulted in respirable dust.”

In the Sept. 13 opinion, the federal appellate court did affirm summary judgment for the defendant on the plaintiff’s turbine-related claims, concluding that there was not enough evidence on the record to prove that the original insulation was present in the turbine when the decedent worked on it.
