Missouri Court Dismisses Federal-Mogul Asbestos Injury Trust from Case, Cites Lack of Personal Jurisdiction

ST. LOUIS –– A Missouri federal court had dismissed asbestos claims asserted against Federal-Mogul Asbestos Injury Trust, finding that it did not have personal jurisdiction over the defendant.

In the Aug. 5 order, the U.S. District Court for the Eastern District of Missouri noted that the defendant would not be subject to general or specific jurisdiction in the state.

Plaintiff Berj Hovsepian asserted the claims, contending that as a civilian employee of the U.S. Navy in the 1950s and 1960s and, additionally, as an employee with Polaroid and Kambien, he performed work on projects that resulted in asbestos exposure. …
