SALEM, Ore. -- An appellate court has affirmed its decision to reverse summary judgment for two automotive asbestos defendants, rejecting the defendants' arguments that the statute of limitations applied to the plaintiff's claims. Keller, et al. v. Armstrong World Industries, et al., No. A117518 (Ore. Ct. App.).
In a June 29 opinion, the Oregon Court of Appeals determined that there was no evidence indicating the plaintiff's physician definitively conveyed to the plaintiff that his illness could possibly be linked to asbestos exposure.
