NEW YORK -- A New York appellate court has affirmed death benefits for the widow of a drywall worker exposed to asbestos, opining that the defendant's insurance company had not proven that it had cancelled coverage. Cammarata v. Caldwell & Cook, Inc., et al., No. 95491 (N.Y. Sup. Ct., App. Div., 3rd Dept.).
In a June 23 decision, Division Three of the Appellate Division of the New York Supreme Court affirmed a decision in which the Workers' Compensation Board found Merchants Mutual Insurance Co. liable for the plaintiff's coverage.
