Indiana Federal Court Refuses to Transfer Asbestos Action to Northern District of Illinois

HAMMOND, Ind. –– A federal court in Indiana has rejected an asbestos plaintiff’s efforts to have the claims transferred to Illinois, finding that there was no evidence to establish that the neighboring state was a “clearly more convenient forum.”
In the July 13 order, the U.S. District Court for the Northern District of Indiana opined that the plaintiff had presented very little argument to demonstrate that the convenience of the parties and witnesses doesn’t favor Indiana.
