Louisiana Court of Appeal Affirms Order Tossing Asbestos Case, Says Medical Causation Expert Testimony Inadmissible

NEW ORLEANS –– A Louisiana appellate court has affirmed the dismissal of an asbestos action, concurring with a lower court’s holding that testimony offered in support of medical causation in the case were not admissible, in part because the expert failed to take into consideration the decedent’s smoking history.

In a June 22 opinion, the Louisiana Court of Appeals for the 4th Circuit concluded that the record was devoid of any genuine issue of material fact to try as to medical causation.
