Maryland Court Awards Summary Judgment to Westinghouse in Asbestos Case

BALTIMORE –– A Maryland federal court has awarded summary judgment to Westinghouse in an asbestos case, finding that the plaintiff had failed to present evidence that the specific Micarta product with which the decedent worked “actually contained asbestos.”
Prior to weighing in on the defendant’s motion for summary judgment in the June 6 opinion, the U.S. District Court of the District of Maryland had determined that the testimony of a plaintiff expert should be excluded for its failure to be grounded in sufficient facts or data.
