Court Denies Motion to Remand Asbestos Suit, Says Plaintiffs Haven’t Demonstrated Viable Claims Against Non-Diverse Defendants

NEW ORLEANS –– A Louisiana federal court has retained jurisdiction over an asbestos exposure suit, determining that the plaintiffs had failed to establish that they would be able to recover damages against the non-diverse defendants.

In the June 7 order, the U.S. District Court for the Eastern District of Louisiana denied the plaintiffs’ motion to remand the lawsuit.

The plaintiffs asserted the claims on behalf of Robin Murphy, contending that his work as an electronic technician at Southern Bell Telephone and as a carpenter helper for Roland Bourgeois exposed him to asbestos-containing materials.
