NEWARK, N.J. -- Liberty Mutual Insurance Co. has filed a declaratory action against fellow insurer, Continental Insurance Co., seeking a determination of Continental's obligation to pay the plaintiff nearly $300,000 in costs related to underlying asbestos litigation. Liberty Mutual v. Continental Insurance Co., No. 05-02749 (D. N.J.).
Liberty Mutual claims in the May 27 complaint filed in the U.S. District Court for the District of New Jersey that it has paid more than its allocated share to asbestos defendant H.M. Royal in defense and indemnification costs.
Specifically, Liberty Mutual seeks $297,403.63 from Continental Insurance.
