Calif. Court Awards Asbestos Defendant Summary Judgment; Says Plaintiff Failed to Raise Triable Issue

LOS ANGELES –– A California federal court has awarded an asbestos defendant summary judgment in a case brought by a boilermaker, concluding that the plaintiffs had failed to raise a triable issue as to whether he was exposed to asbestos dust attributable to the defendant.

In the April 25 order, the U.S. District Court for the Southern District of California rejected the plaintiff’s efforts to pursue claims outside of the state’s workers’ compensation act.

The plaintiffs asserted the claims on behalf of Michael Walashek, contending that he was exposed to asbestos-containing products while working as a boilermaker. As …
