HOUSTON -- A Texas asbestos MDL hearing scheduled to address Union Carbide's summary judgment motion made on the ground that it owes no duty to the plaintiffs based on its role as a bulk supplier has been continued, sources told HarrisMartin Publishing. In re: MDL Asbestos Litigation, No. 2004-03964 (Texas 11th Jud. Dist. Ct., Harris Cty.).
The hearing before Judge Mark Davidson of the 11th Judicial District Court for Harris County was set to go June 30, but did not go forward because of procedural issues, sources said.
