Fla. Court Dismisses Misrepresentation Claim Without Prejudice in Asbestos-Containing Talc Action

OCALA, Fla. –– A Florida federal court has dismissed intentional or negligent misrepresentation claims asserted against three defendants in an asbestos-containing talc exposure suit, finding that the plaintiffs had failed to outline the alleged misrepresentation, who made it, when and how it was made, and how the decedent came to rely on it.

In the April 8 order, the U.S. District for the Middle District of Florida did allow the plaintiffs 14 days to amend their complaint to fix the deficiency as to this claim, however.
