Calif. Court Dismisses Majority of Asbestos Plaintiffs’ Claims, Cites Exclusive Remedy Provision of Workers’ Compensation Act

SAN FRANCISCO –– A California court has dismissed the majority of the claims brought in an asbestos suit, opining that they are barred by the exclusive remedy provision in the state’s Workers’ Compensation Act.

In the March 23 opinion, the U.S. District Court for the Northern District of California did allow the plaintiffs leave to amend its complaint in order to properly plead one cause of action for fraudulent concealment.
