Calif. Court Affirms Summary Judgment Award to BASF in Asbestos Case

SAN FRANCISCO –– A California appellate court has affirmed an award of summary judgment to BASF, concluding that the plaintiffs had only shown the possibility of asbestos exposure in a case that involved a product in which asbestos was allegedly present as a result of impurity in talc.
In the March 15 opinion, the California First District Court of Appeal opined that while there was sufficient evidence to support a finding that the plaintiff worked with BASF’s Bondo product, there is insufficient evidence to prove that the auto body filler contained asbestos fibers.
