N.Y. Court Denies Motion for Summary Judgment, Says Issues of Fact Exist in Asbestos Case

NEW YORK –– A motion filed by Union Carbide for summary judgment in an asbestos case involving its Calidria and Bakelite products has been denied by a New York court, which found that issues of fact existed as to whether the plaintiff was exposed to the company’s asbestos-containing products.

In the Feb. 22 order, the New York Supreme Court for New York County opined that the fact that Union Carbide manufactured asbestos-free products that might match descriptions proffered by the plaintiff does not mean the decedent solely came into contact with those products.
