Louisiana Court Denies Motion to Remand Asbestos Suit, Says ‘Removal Procedurally Proper In All Respects’

NEW ORLEANS –– A Louisiana federal court has declined to relinquish jurisdiction over an asbestos lawsuit, finding in part that the removing defendant had not removed the case prior to being served.

In the Feb. 25 order, the U.S. District Court for the Eastern District of Louisiana opined that “removal was procedurally proper in all respects.”

Mississippi citizen David W. Colletti filed the underlying asbestos lawsuit in the Louisiana Civil District Court for the Parish of Orleans. Among the defendants named in the complaint was Burmaster Land & Development Co.
