BOSTON –– A Massachusetts federal court has dismissed for failure to state a claim an asbestos-related insurance action, ruling that the plaintiff had failed to prove that the acquisition of a building material supply company was executed in an attempt to avoid future liabilities or defraud creditors.
In the Feb. 5 order, the U.S. District Court for the District of Massachusetts said, in the absence of that evidence, it could not justify imposing successor liability.
