Ky. Court of Appeals Affirms Summary Judgment Award for Fluor Enterprises in Asbestos Action




LEXINGTON, Ky. – A Kentucky appellate court has affirmed an award of summary judgment to Fluor Enterprises Inc. in an asbestos action, concluding that the plaintiff’s engineering expert had failed to establish that the defendant owed a standard of care to the decedent.

In the Jan. 22 opinion, the Kentucky Court of Appeals further found that it could not “retroactively impose contemporary standards of care on design engineers.”

The plaintiffs asserted the claims on behalf of Oscar Mindel Jr., contending that his work as a laboratory assistant at Louisville Gas & Electric exposed him to asbestos-containing products. The plaintiffs specifically …
