Del. Court Grants Warren Pumps’ Motion to Strike Deposition Notices in Asbestos Cases

WILMINGTON, Del. –– A Delaware federal court has granted an asbestos defendant’s motion to strike deposition notices, saying that the notices were outside the scope of an extended discovery period.

In the Dec. 18 order, the U.S. District Court for the District of Delaware said that the intent of the original order was not to allow the plaintiff to take any discovery of any kind from the remaining defendants.

The plaintiffs asserted the claims on behalf of David MacQueen, contending that his lung cancer was caused by exposure to asbestos. MacQueen allegedly came into contact with asbestos-containing products while …
