Calif. Appellate Court Affirms Summary Judgment Award for Fluor in Asbestos Case

LOS ANGELES –– A California appellate court has affirmed an award of summary judgment entered in favor of Fluor Corp. in an asbestos case, saying that the evidence on which the plaintiffs now rest was not identified in his written discovery responses.

In the Dec. 15 opinion, the California Second District Court of Appeal opined that none of the evidence provides enough circumstantial support to support an inference that the tower on which the plaintiff worked was constructed with asbestos-containing materials.
