Virginia Court Awards Summary Judgment to Westinghouse in Case Involving Asbestos-Containing Arc Chutes

NEWPORT NEWS, Va. –– A Virginia federal court has awarded summary judgment to Westinghouse in an asbestos case, finding that while a genuine issue of material fact exists as to whether the defendant’s arc chutes contained asbestos, one does not exist with regard to whether those chutes released asbestos fibers in an amount that was substantial enough to cause the plaintiff’s mesothelioma.

In the Nov. 19 opinion, the U.S. District Court for the Eastern District of Virginia rejected the plaintiff’s reliance on testimony from an expert that was previously found by the court to be unreliable.
