SEATTLE –– A Washington appellate court has reversed a trial court ruling denying a motion for summary judgment filed by asbestos defendants who were named in a widow’s wrongful death suit but not in the decedent’s original personal injury action.

In the Nov. 9 opinion, Washington Court of Appeals, Division One, noted it recently held in another asbestos action that “there is no viable cause of action for wrongful death once an individual allows the statute of limitations to expire on his underlying personal injury claim during his lifetime.” [Deggs v.
