Ky. Federal Court Severs Third-Party Claim, Remands Asbestos Exposure Suit

LOUISVILLE, Ky. –– A Kentucky federal court has declined to exercise jurisdiction over an asbestos exposure suit, after finding that third-party claims asserted by one of the defendants should be severed from the complaint.

In the Oct. 26 opinion, the U.S. District Court for the Western District of Kentucky noted that at the time of removal, the underlying case was almost 22 months old and was set for trial.

The plaintiffs asserted the claims, contending that Glen Dale Brown was exposed to asbestos during the course of his employment. Among the defendants named in the lawsuit is General Electric Co., …
