Calif. Court Enters Judgment in Favor of Asbestos Defendant, Says ‘No Genuine Issue of Material Fact’ Exists

LOS ANGELES –– A California federal court has entered judgment in favor of asbestos defendant Eaton Corp., echoing an earlier order in which it determined that the plaintiffs had failed to establish that asbestos fibers from the defendant’s product were a substantial contributing factor in the decedent’s illness.

The U.S. District Court for the Central District of California entered the judgment in a two-page order on Oct. 14.

The plaintiffs asserted the asbestos-related claims on behalf of Gerald Livingston. According to the court, Livingston was a “career aircraft electrician” that served in the U.S. Air Force. During that time, Livingston …
