9th Circuit Affirms Award of Summary Judgment to 3 Asbestos Defendants

SAN FRANCISCO –– The U.S. Court of Appeals for the 9th Circuit has affirmed an award of summary judgment for three asbestos defendants, ruling in part that testimony from a plaintiff expert in a separate case was “too generic to create a fact issue for this case and these defendants.”

In the Oct. 14 opinion, the 9th Circuit further found that there was no evidence that the defendants had provided the asbestos-containing replacement parts.

Plaintiffs Jeffrey Lannes and Kristi Johnson appealed the federal court’s award of summary judgment to Flowserve U.S. inc., Jerguson Gage & Valve Co., and Warren Pumps.
