Ill. Court Denies Honeywell’s Motion for Summary Judgment in Case Involving Bendix Brakes

EAST ST. LOUIS, Ill. –– Honeywell’s attempts to obtain summary judgment in an asbestosis case have been rejected by an Illinois federal court, which opined that expert testimony that discusses the “every exposure” theory is not an automatic trigger for inadmissibility.
In the Oct. 2 opinion, the U.S. District Court for the Southern District of Illinois also rejected the notion that the plaintiff’s deposition testimony was inadmissible hearsay.
The plaintiffs alleged in the complaint that Richard W. Bell was exposed to asbestos-containing products he encountered while performing car repairs using brakes manufactured by Honeywell.
