ROCHESTER, N.Y. –– A New York appellate court has refused to rehear arguments in a dispute over whether a trial court was correct in denying Crane Co.’s motion for summary judgment in an asbestos case.

In an Oct. 2 order, the New York Supreme Court, Appellate Division, Fourth Department, also denied a motion for leave to appeal to the Court of Appeals, ultimately standing by its determination that the plaintiff had established a question of fact as to whether the defendant knew that the asbestos-free components would not be able to withstand the heat for the intended purpose of the …
