Ill. Court Retains Jurisdiction of Asbestos Case, Says Defendant Established Colorable Federal Defense

EAST ST. LOUIS, Ill. –– An Illinois federal court has retained jurisdiction over an asbestos case, finding that the defendant had established a colorable defense as to the use-of-asbestos claim.

In the Sept. 28 order, the U.S. District Court for the Southern District of Illinois opined that CBS Corp. had presented enough evidence to establish that military documents outlined the specifications of the turbines at issue in the case.

David Bailey filed the claims in the Third Judicial Circuit Court for Madison County, alleging that he was injured as a result of asbestos exposure.
