Texas Court Affirms Asbestos Verdict, Strikes Punitive Damage Award

EL PASO, Texas - A Texas appeals court has affirmed the majority of a nearly $2 million award to a laborer who suffered from asbestosis as a result of his exposure to an asbestos-containing insulating cement. Quigley Company, Inc. v. Calderon, No. 08-01-00346 (Texas App. Ct., Eighth Dist.).

The Eighth District Texas Court of Appeals' decision to affirm a trial court's entry of judgment on behalf of Miguel Augustin Calderon coincided with its reversal of the punitive damage award entered against Quigley Corp., who produced the cement product, Insulag.
