Tenn. Court Won’t Issue Advisory Opinion on Whether Louisiana Court Has Personal Jurisdiction Over Defendants

NASHVILLE, Tenn. – A Tennessee federal court has declined to issue an advisory opinion on whether a Louisiana court –– where the underlying asbestos claims were recently transferred – has personal jurisdiction over the defendants, saying that doing so would be a “tremendous waste of time.”

In the Aug. 4 opinion, the U.S. District Court for the Middle District of Tennessee rejected the defendants’ position that in order to transfer venue, the court must also find that the defendants are subject to personal jurisdiction in Louisiana.
